These Terms of Service (“Terms”) govern your use of the AI4SmallBusiness website and services. By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree, you must not use our Site or Services.

1. Definitions

• “AI4SmallBusiness”, “we”, “us”, “our” – the operator of this website and provider of AI agent services.
• “Services” – all products, tools and services we provide, including AI agents such as ZzzBot, demos, support and integrations.
• “Customer”, “you”, “your” – any individual or organisation using our Site or Services.
• “Site” – the website located at https://ai4smallbusiness.co.za and related pages.

2. Eligibility

By using our Site or Services, you confirm that you are at least 18 years old (or have legal capacity to contract) and, where applicable, you are authorised to act on behalf of the business you represent.

3. Description of Services

We provide small businesses with AI-powered agents and automations, including but not limited to:

• ZzzBot (accommodation booking assistant);
• Custom AI agents configured to your workflow;
• Demo experiences on the Site;
• Support, training and configuration services.

We may change, improve or discontinue parts of the Services at any time.

4. Accounts and Access

Some Services may require an account or login credentials. You agree to:

• Provide accurate and up-to-date information;
• Keep login details confidential;
• Notify us immediately if you suspect unauthorised use of your account.

You are responsible for all activity that occurs under your account.

5. Subscriptions, Pricing and Payments

5.1 Subscription plans

Certain Services are offered on a subscription basis. The applicable fees, billing cycle and features will be described on our Site or in your proposal or invoice.

5.2 Payment processing

We may use third-party payment processors such as Paystack. By subscribing or purchasing, you authorise us and our payment processors to charge your selected payment method for recurring subscription fees and any agreed setup or once-off fees.

5.3 Billing and renewal

• Subscriptions may renew automatically at the end of each billing period unless cancelled in advance.
• You can request cancellation by contacting us before the next billing date.
• If payment fails, we may suspend or terminate your access to the Services.

5.4 Refunds

Unless stated otherwise in a written agreement, setup fees and previous subscription periods are non-refundable. We may offer refunds at our discretion but are not obliged to do so.

6. Your Responsibilities

You are responsible for how you and your staff use the Services. In particular, you agree to:

• Ensure your use complies with applicable laws (including privacy and consumer protection);
• Provide accurate and up-to-date rules, pricing and availability for your AI agents;
• Review bookings, messages and actions taken by your AI agent and correct any errors.

You must not use the Services to:

• Engage in illegal, harmful or fraudulent activities;
• Harass, threaten or harm others;
• Send spam or unauthorised marketing;
• Infringe intellectual property or privacy rights.

7. AI Behaviour and Limitations

Our agents rely on AI models and automations. While we design them to be accurate and helpful, you acknowledge that:

• AI outputs may occasionally be incorrect, incomplete or inappropriate;
• The Services are assistive tools and do not replace human judgement or professional advice;
• You remain responsible for your business decisions, policies and customer relationships.

8. Data and Content

8.1 Your Data

“Your Data” includes information you provide to configure the agent and any customer data processed by your agent (e.g. booking details, contact information, messages).

You retain ownership of Your Data. You grant us a limited, non-exclusive licence to process and store Your Data for the purpose of providing and improving the Services and meeting our legal obligations.

8.2 Aggregated and anonymised data

We may create aggregated, anonymised data derived from Your Data and service usage. We may use this for analytics, product improvement and marketing (for example “average time saved”), provided it does not directly identify you or your customers.

8.3 Third-party platforms

If you connect the Services to third-party platforms (WhatsApp, Telegram, Google Calendar, Airbnb, LekkeSlaap, Paystack, etc.), you are responsible for complying with their terms. We are not responsible for issues arising from those platforms.

9. Intellectual Property

All intellectual property in the Site and Services (including software, flows, prompts, designs, logos and branding) belongs to AI4SmallBusiness or its licensors.

We grant you a limited, non-exclusive, non-transferable licence to use the Services for your own business during your subscription, subject to these Terms.

You may not:

• Copy, modify, reverse engineer or create derivative works of our software or flows;
• Resell or sublicense the Services as your own product without a written agreement;
• Use our branding or trademarks without permission.

10. Service Availability

We aim to keep the Services available and performant, but we do not guarantee:

• Uninterrupted or error-free operation;
• Specific uptime levels;
• Immediate resolution of all issues.

We may occasionally need to perform maintenance or updates, or change or discontinue certain features. We will try to give reasonable notice of major changes where practical.

11. Disclaimers

To the fullest extent allowed by law:

• The Site and Services are provided on an “as is” and “as available” basis;
• We make no warranties, express or implied, including fitness for a particular purpose, non-infringement and reliability of AI outputs;
• We do not guarantee specific results such as increased sales, bookings or revenue.

Nothing in the Services constitutes legal, financial, tax or professional advice.

12. Limitation of Liability

To the extent permitted by law:

• Our total liability arising out of or relating to the Site or Services is limited to the amount you paid to us in the three (3) months prior to the event giving rise to the claim;
• We are not liable for indirect, consequential, special or punitive damages, or for loss of profits, revenue, goodwill or data.

Nothing in these Terms excludes liability for fraud, intentional misconduct, or any liability that cannot be excluded under applicable law.

13. Indemnity

You agree to indemnify and hold AI4SmallBusiness harmless from any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from:

• Your use of the Site or Services;
• Your breach of these Terms;
• Your misuse of AI outputs; or
• Any claim relating to Your Data or your customers’ data where we acted on your instructions.

14. Termination and Suspension

We may suspend or terminate your access to the Services if:

• You breach these Terms and fail to remedy the breach within a reasonable time;
• You fail to pay fees when due;
• We are required to do so by law or a competent authority.

You may stop using the Site at any time and may cancel your subscription in line with the applicable billing terms.

Upon termination, your right to use the Services ends. We may retain certain data as required by law or for legitimate business purposes, consistent with our Privacy Policy.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of South Africa. Any disputes arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the South African courts, unless mandatory law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the “Last updated” date. If you continue to use the Site or Services after changes take effect, you are deemed to have accepted the updated Terms.
